Myriad Cloud Terms of Broadcasting

The Terms of Broadcasting (Acceptable Use Policy or “AUP”) outlines the rules for the use of Myriad Cloud (the "Platform") and the expected standards of customers’ radio services (the “Radio Service”). Myriad Cloud is a product of Broadcast Radio Ltd. "Broadcast Radio".

For avoidance of doubt, the different subscription levels of Myriad Cloud (Basic, Standard, Pro, Ultimate - but not Dedicated) shall be considered the same product.

This policy is designed to ensure the Platform is a safe, lawful, and respectful environment. Violation of this AUP may result in the suspension or termination of your access to the Platform. We reserve the right to modify this policy at any time, and it is your responsibility to review it periodically for any updates.

  1. Lawful Use:
    • 1.1 You must comply with all applicable local, national, and international laws (including the laws of the United Kingdom) and regulations while using the Platform.
    • 1.2 You may not use the Platform to transmit, distribute, or store any material that infringes upon any copyright, trademark, or intellectual property rights of others.
  2. Content Guidelines:
    • 2.1 You are solely responsible for the content you create, upload, transmit, or share on the Platform.
    • 2.2 You may not upload or transmit any content that is illegal, obscene, defamatory, threatening, harassing, hateful, discriminatory, or otherwise objectionable.
    • 2.3 You may not upload or transmit any content that incites violence or promotes illegal activities.
    • 2.4 Notwithstanding public interest in news reporting, you must ensure your radio service does not infringe upon an individual’s right to privacy, with particular due regard to the privacy of under 18s.
  3. Intellectual Property:
    • 3.1 If the Radio Service includes recorded music, you must ensure you have the appropriate music licensing from your regional music licensing authority – for example, in the United Kingdom, PRS for Music and PPL.
    • 3.2 You may not use the Platform to distribute or share copyrighted material without the explicit permission of the copyright holder.
    • 3.3 You may not use the Platform to distribute or share any material that violates any trademark, patent, trade secret, or other intellectual property rights.
    • 3.4 You are solely responsible for ensuring your radio service is geographically limited to appropriate regions. Broadcast Radio may limit your radio service internationally if it receives a complaint from an international music licensing authority.
  4. Privacy and Security:
    • 4.1 You are responsible for maintaining the security and confidentiality of your account information.
    • 4.2 You may not attempt to gain unauthorized access to the Platform, other user accounts, or any computer systems or networks connected to the Platform.
    • 4.3 You may not engage in any activity that disrupts or interferes with the proper functioning of the Platform or its services.
    • 4.4 You may not engage in “penetration testing” or other “ethical hacking” activities on the Platform without the explicit written consent of Broadcast Radio.
  5. Prohibited Activities:
    • 5.1 You may not engage in any activity that violates this AUP, including but not limited to:
      • a) Using the Platform to send unsolicited commercial messages (spam).
      • b) Impersonating any person or entity, or falsely representing your affiliation with any person or entity.
      • c) Engaging in any form of illegal gambling or gaming activities.
      • d) Distributing malware, viruses, or any other malicious software.
      • e)  Engaging in any form of hacking, cracking, or unauthorized access to systems or networks.
  6. Consequences of Non Compliance:
    • 6.1 Violation(s) of this AUP may result in your Radio Service being temporarily limited.
    • 6.2 Severe or repeated violation(s) of this AUP may result in the suspension or termination of your access to the Platform, at our discretion.
    • 6.3 Where possible, Broadcast Radio Ltd. will attempt to contact the customer before undertaking any remedial action, but this it at the sole discretion of Broadcast Radio Ltd.

Remember that this AUP is not an exhaustive list of prohibited activities. Broadcast Radio Ltd. reserves the right to take action against any user or content that we determine, in our sole discretion, to be harmful, inappropriate, or in violation of this AUP.

By using the Platform, you acknowledge that you have read, understood, and agree to abide by this Acceptable Use Policy.

Services provided as part of a free trial/evaluation period are subject to the following limitations:

  • 7.1 You acknowledge that the trial service is provided without warranty, express or implied. Although we will make reasonable efforts to provide the service on a best-effort basis, we cannot guarantee any percentage or level of service availability without a paid subscription.
  • 7.2 Broadcast Radio Ltd reserves the right to withdraw the evaluation period at any time without notice. Customers are not entitled to more than one free trial/evaluation period of the same product without the consent of Broadcast Radio Ltd.
  • 7.3 You acknowledge that some products generally included as part of a subscription level (such as mobile apps) are not available for evaluation, due to technical constraints.
